These Terms of Use (“Terms”) govern your access to and use of Cashflo (“Company,” “we,” “our,” or “us”), including our website, software, tools, services, content, and related features (collectively, the “Services”).

By accessing or using the Services, you agree to be bound by these Terms. If you do not agree, do not use the Services.

1. Eligibility

You must be at least 18 years old and legally capable of entering into binding contracts to use the Services. If you use the Services on behalf of a company, you represent that you have authority to bind that entity.

2. Changes to Terms

Cashflo reserves the right to modify these Terms at any time. Updated Terms become effective upon posting. Continued use of the Services constitutes acceptance of the revised Terms.

We reserve the right to modify, suspend, or discontinue any portion of the Services at any time.

4. Account Registration and Security

You agree to:

Cashflo is not liable for losses resulting from unauthorized access due to your failure to safeguard credentials.

5. Fees and Payments

- Fees may be recurring unless otherwise stated

- All fees are non-refundable unless explicitly stated

- You authorize us (or our payment processor) to charge your designated payment method

Cashflo reserves the right to suspend Services for nonpayment.

6. Intellectual Property

All content, software, branding, materials, systems, processes, and proprietary methodologies provided through the Services are owned by Cashflo or its licensors.

You may not:

- Copy, reproduce, distribute, modify, or create derivative works

- Reverse engineer or attempt to extract source code

- Use the Services to build a competing product

Unauthorized use may result in legal action.

7. Acceptable Use

You agree not to:

- Violate any applicable laws or regulations

- Interfere with system integrity or security

- Attempt unauthorized access

- Use the Services for fraudulent, deceptive, or illegal purposes

- Transmit harmful code, malware, or spam

Cashflo may suspend or terminate access for violations.

8. User Content

If you submit or upload content:

- You retain ownership of your content

- You grant Cashflo a limited license to use it to provide the Services

- You represent that you have rights to submit such content

Cashflo is not responsible for user-submitted content.

9. SMS Communications

Cashflo may send transactional, informational, and promotional text messages to users who provide prior express consent.

- Message frequency may vary.
- Message and data rates may apply.

- You may opt out at any time by replying STOP.

Carriers are not liable for delayed or undelivered messages.

10. Third-Party Services

The Services may integrate with third-party platforms (e.g., payment processors, hosting providers, marketing platforms).

Cashflo is not responsible for third-party services and disclaims liability for their actions or failures.

11. Disclaimer of Warranties

The Services are provided “as is” and “as available.”

Cashflo makes no warranties, express or implied, including:

- Merchantability

- Fitness for a particular purpose

- Non-infringement

- Accuracy of results

Cashflo does not guarantee uninterrupted or error-free operation.

12. Limitation of Liability

To the maximum extent permitted by law:

Cashflo shall not be liable for indirect, incidental, special, consequential, or punitive damages.

Cashflo’s total liability for any claim arising from the Services shall not exceed the total fees paid by you in the twelve (12) months preceding the claim.

13. Indemnification

You agree to indemnify and hold harmless Cashflo, its officers, directors, employees, and affiliates from claims, damages, losses,

liabilities, and expenses arising from:

- Your use of the Services

- Your violation of these Terms

- Your violation of any law or third-party rights

14. Termination

Cashflo may suspend or terminate your access at any time for any reason, including violation of these Terms.

Upon termination:

- Your right to use the Services ceases immediately

- Payment obligations survive termination

15. Governing Law and Dispute Resolution

These Terms are governed by the laws of Utah, without regard to conflict of law principles.

Any dispute shall be resolved through binding arbitration in Utah, unless otherwise required by law.

You waive the right to participate in class actions.

16. Force Majeure

Cashflo is not liable for delays or failures caused by events beyond our reasonable control, including acts of God, internet outages, cyberattacks, labor disputes, or government actions.

17. Severability

If any provision of these Terms is found unenforceable, the remaining provisions remain in effect.

18. Privacy

Your use of the Services is also governed by our Privacy Policy.
